Zoning & Development; Applications & Permits

Variance Application: Requests for Zoning Variance must follow Chapter V-5 and meet all criteria to be considered. A variance may be requested for the Superfund Overlay Zone, and must follow criteria in VI-F-4 to be considered. Variances from the zoning regulations are heard before the Board of Adjustments. Variances from subdivision regulations are presented before the Planning Board for recommendation to the County Commission. The County Commission must approve any variance from subdivision standards (See Subdivision Regulations II-B-8, IV-A-3, Chapter XI)

Conditional Use Permit Application: A CUP must be obtained from the Planning Board before any non-residential use that may change any of the following due to the construction, placement, or expansion of a use or structure: traffic flow or volume, noise, visual pollution, air quality, fire safety, or a change is use that may otherwise or unacceptably affect the natural or human environment or be harmful to health and safety. Refer to zoning regulations for CUP specifications in each district. Communication or wind generation facilities or towers are to follow Development Certificate provisions in III-A and CUP provisions in IV-F or IV-G.

Development Certificate: A development Certificate must be obtained from the Planning Department before:

  • 1.  Any person changes existing land use to a residential use through the construction or placement of a residential structure
  • 2. Expansion of a communication or winder generation facility or tower by less than ½.
